1. Scope of Application

These Terms of Use apply to the mobile application Lost Chapters (“App”), regardless of the user’s location. They apply to all users worldwide who download and use the app via the Apple App Store.

By installing and using the app, you agree to these terms.

2. Features of the App

The app is an audiobook player that allows users to play, manage, and save the listening progress of DRM-free (copy-protection-free) audiobook files purchased from third parties on their devices. The app includes the following features:

The app does not include any audiobook content provided by the provider.

Optionally, the app allows the user to download free demo data from Apple servers after installation. These files consist exclusively of silence but contain structured metadata that can be used to realistically test the app’s features (e.g., user interface, scanning, chapter display).

These demo files are provided solely for demonstration and testing purposes and may not be used for any other purpose, distributed, made publicly available, or modified.
Commercial or content-related use of the demo files is expressly prohibited.

3. Usage Requirements and Purchase

For the use of the app, a one-time purchase is required, which is concluded and managed via the Apple App Store. The transaction is handled entirely through Apple’s payment systems.

The purchase price is set by the provider and displayed in the App Store.

The app is provided in its current state at the time of purchase (“as is”). There is no entitlement to future updates, new features, or continued compatibility with future versions of the operating system (iOS/iPadOS). If the app is removed from the store or discontinued, the availability for re-download (e.g., via purchase history) depends solely on Apple’s technical capabilities and policies.

The provider does not receive any personal data (e.g., name, email, or payment information) in connection with the purchase.

4. Technical Requirements

The app requires a supported Apple device with installed iOS or iPadOS and, if applicable, an active Apple ID.

The app uses only system services provided by Apple.

5. Intellectual Property Rights

The app, including all its components (e.g., source code, UI, logos, texts), is protected by copyright.
You are granted a simple, non-exclusive right to use the app on your own devices in accordance with these Terms of Use.

It is not permitted to copy, modify, distribute, or make the app or parts of it available to third parties, whether for free or for a fee.

6. User Content and Responsibility

The app accesses audiobook files that are placed by the user in the app’s “Documents” folder, e.g., via the Apple Files app.

The app only reads these files for playback and metadata display purposes.
There is no possibility within the app to delete, rename, move, or modify these files.

The management of the files is carried out solely by the user outside the app.
The user is therefore solely responsible for the organization, backup, and legality of the audiobook data used in the app.

7. Availability and Changes

The provider makes every effort to ensure stable and error-free operation of the app. However, no guarantee is given for specific availability or functionality.

The provider reserves the right to further develop, modify, or discontinue the app or individual features, provided this is reasonable for the user.

8. Liability

The provider shall be liable without limitation in cases of intent and gross negligence, as well as for damages resulting from injury to life, body, or health and under the Product Liability Act.

In cases of slight negligence, the provider shall only be liable for the breach of essential contractual obligations (cardinal duties) and limited to the typical, foreseeable damage.

The provider reserves the right to amend these Terms of Use if required for technical, legal, or content-related reasons. Changes will be announced in the app or on the website.

10. Governing Law

These terms are governed by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).
If you use the app as a consumer and your habitual residence is in another country, the mandatory consumer protection provisions of that country remain unaffected.

These Terms of Use are available in German and English.
In case of discrepancies or questions of interpretation, the German version shall prevail.
