1. Scope of Application
These Terms of Use apply to the mobile application Lost Chapters (“App”), regardless of the user’s location.
They apply to all users worldwide who download and use the app via the Apple App Store.
By installing and using the app, you agree to these terms.
2. Features of the App
The app is an audiobook player that allows users to play, manage, and save playback positions of copy protection-free (DRM-free) audiobook files on their devices. The app includes the following features:
- Playback of audiobooks
- Display of metadata (e.g., cover, title, duration)
- Optional synchronization via Apple iCloud
The app does not include any audiobook content provided by the provider.
Optionally, the app allows the user to download free demo data from Apple servers after installation. These files consist exclusively of silence but contain structured metadata that can be used to realistically test the app’s features (e.g., user interface, synchronization, chapter display).
These demo files are provided solely for demonstration and testing purposes and may not be used for any other purpose, distributed, made publicly available, or modified.
Commercial or content-related use of the demo files is expressly prohibited.
3. Subscription Requirements
The use of the app requires a paid subscription, which is concluded and managed via the Apple App Store. Technical handling is carried out via Apple StoreKit 2.
Prices and subscription periods are set by the provider and displayed in the app or App Store.
The provider does not receive any personal data (e.g., name, email, payment information) in connection with the subscription.
4. Technical Requirements
The app requires a supported Apple device with installed iOS or iPadOS and, if applicable, an active Apple ID.
Some features (e.g., iCloud synchronization) require iCloud to be enabled.
The app uses only system services provided by Apple. It does not establish any own internet connections.
5. Intellectual Property Rights
The app, including all its components (e.g., source code, UI, logos, texts), is protected by copyright.
You are granted a simple, non-exclusive right to use the app on your own devices in accordance with these Terms of Use.
It is not permitted to copy, modify, distribute, or make the app or parts of it available to third parties, whether for free or for a fee.
6. User Content and Responsibility
The app accesses audiobook files that are placed by the user in the app’s “Documents” folder, e.g., via the Apple Files app.
The app only reads these files for playback and metadata display purposes.
There is no possibility within the app to delete, rename, move, or modify these files.
The management of the files is carried out solely by the user outside the app.
The user is therefore solely responsible for the organization, retention, backup, and legality of the audiobook data used in the app.
7. Availability and Changes
The provider makes every effort to ensure stable and error-free operation of the app. However, no guarantee is given for specific availability or functionality.
The provider reserves the right to further develop, modify, or discontinue the app or individual features, provided this is reasonable for the user.
8. Disclaimer of Liability
Use of the app is at your own risk.
The provider is only liable for damages caused intentionally or by gross negligence.
In particular, no liability is assumed for:
- Data loss due to user actions
- Problems related to Apple services (e.g., iCloud, StoreKit)
- Damages caused by faulty or unauthorized audiobook files
9. Amendments to These Terms
The provider reserves the right to amend these Terms of Use if required for technical, legal, or content-related reasons. Changes will be announced in the app or on the website.
10. Governing Law
These terms are governed by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).
If you use the app as a consumer and your habitual residence is in another country, the mandatory consumer protection provisions of that country remain unaffected.
Language and Legal Validity
These Terms of Use are available in German and English.
In case of discrepancies or questions of interpretation, the German version shall prevail.
